Licensing through the government (Grenada)

1) Who regulates and through whom to file

• Casino Gaming Act 2014 is a separate law for casinos at hotels/resorts with 300 + rooms (GTA accreditation/Minister's decision). A license is only possible if the number of rooms threshold and fit & proper criteria are met.
• Gaming Act 2016 + Gaming Regulations (SRO 48/2016) - "general" framework: licensing and supervision of other types of gaming, definition of license categories, application forms, inspections and sanctions. The law establishes the Gaming Commission as a regulator.
• Entry point: since 2017, the Gaming Secret (front office at the Ministry of Legal Affairs in St. George) has been operating - this is where requests for registration of operators/importers and procedures are traditionally addressed.

2) What licenses exist (according to SRO 48/2016)

• Gaming Machines Operating License - for the operation of slot machines (only stand-alone machines are allowed in Grenada; connection to the central network is prohibited by regulations).
• General Lotteries Operating License and Special Lotteries Operating License are modes for lottery activities outside the NLA monopoly in the prescribed cases (taking into account the fact that national lotteries are conducted by NLA).
• Additionally, there are application forms, registries, record retention and internal control requirements for licensees.

3) Roles and responsibilities of authorities

Gaming Commission: licensing/suspension/cancellation, inspections, guidelines, sanctions. Created by a 2016 law.

Gaming Secretary (Ministry of Legal Affairs): communication with applicants, acceptance of registrations of existing operators and importers, help on procedures, operational support for launching the mode.

National Lotteries (NLA): State Lotto Products Operator (Lotto, Super 6, Pick 3, scratch games); conducts its own online services for users.

4) Basic requirements for applicants (summary according to the law/regulations)

Integrity and "fit & proper" of beneficiaries and key officers; no relevant convictions. (For casinos - especially strictly according to the 2014 act)

Financial viability and confirmation of sources of funds, compliance of sites/equipment with standards.

Internal control, accounting, reporting, access to inspectors; compliance with age restrictions and responsible play measures.

For slot machines - compliance with stand-alone parameters and other technical requirements of SRO 48/2016.

5) Procedure: how the application path usually looks

1. Preliminary consultation with Gaming Secretary (clarification of the category, list of documents, form templates and deadlines).

2. Package of documents according to SRO 48/2016 forms - constituent documents, information on the ownership structure, "fit & proper," business plan, financial and technical. descriptions, AML/RG policies.

3. Submission to the Commission (through the Secretariat), payments on duties/fees (for specific tariffs, see the current regulatory tables/announcements).

4. Inspection, decision-making, license issue or motivated refusal; Gaming Appeals Tribunal is valid for controversial issues (spelled out in the appendix to the 2016 law).

5. Operation and supervision: record keeping, reporting, license renewal, inspections, compliance with advertising and age restrictions.

6) What about "online" and remote services

A separate national B2C online mode (as in a number of neighbors) is not described in the primary texts 2014/2016; the regulations have forms regarding e-gaming, but this is not an expanded remote architecture with a register of online operators, mandatory local hosting RNG, etc. Therefore, "licensing through the government" in 2025 should be understood as offline/electronic formats according to Gaming Act 2016 and casinos with 300 + numbers according to the law 2014

7) Liability for violations

Operating without a license is subject to Cap's criminal provisions. 120 (including "common gaming house," excitement in a public place). Sanctions include fines and/or imprisonment.

According to the law of 2016, the Commission has the right to suspend/cancel licenses and prosecute for obstruction of inspection, false information, etc.

8) Practical checklist for applicant

Define the category (casino with 300 + numbers vs club/machines/lotteries).

Ask Gaming Secret for the latest forms/instructions and a list of documents for your category.

Prepare AML/RG policies, cash control/record descriptions, room/equipment plan.

For automatic machines, check compliance with stand-alone mode (without central network) and accounting/sealing requirements.

Check interaction with NLA if your model affects lotteries/draws.

Can I open a casino without 300 rooms? No, it isn't. The 2014 law only allows casinos as part of a hotel/resort with 300 + rooms.

What about online casinos? Primary acts do not contain a separate national B2C online licensing.
