Online gambling: status before and after 2023-2024
1) "Before": without a special law and with attempts to point prohibitions
Until 2023, Chile did not have a specific law on online gambling: offline casinos were regulated under Law No. 19. 995 and SCJ regulations, but online remained out of direct permissive mode. In 2022, the Supreme Court still refused Polla Chilena to block 23 offshore sites - no systemic solution appeared then.
2) Turning point in 2023: the Supreme Court declared online betting illegal and launched blocking
In September 2023, Chile's Supreme Court ruled that online betting without special permission was illegal activity and ordered the communications provider to block 23 platforms. This was the first "hard" point in law enforcement against illegal sites.
3) 2023-2024: the "gray zone" is shifted to legalization through the bill
In parallel with the judicial line, Congress entered (and advanced) the draft law on online betting platforms - Boletín 14838-03 (second reading in the Senate). The materials of the Library of Congress and the Ministry of Finance record the arkhіtekturu of the future regime: identification, AML/CTF, certification of games, fiscal deductions and strict advertising rules.
4) 2025: strengthening both the judicial and legislative sides
Courts. In the fall of 2025, the Supreme Court again ordered the largest telecom operators (Claro, Entel, Movistar, WOM, VTR, etc.) to immediately block access to unlicensed platforms throughout the country. Until the adoption of the law, online operators remain outside the "white" regime.
Senate. On August 6-13, 2025, the Senate Finance Commission completed its consideration "in general" and the Senate approved the initiative as a whole. Among the key parameters are 2% of the annual GGR on rates in favor of the National Institute of Sports (IND) with distribution to the federations, the NOC and the Paralympic Committee.
5) What exactly changes "after" the adoption of the law (expected configuration)
If the project is finally accepted and promulgado, the online market will receive:- Permissive mode (licenses/platform registration), full player identification, AML/CTF rules, and game/randomness certification.
- Taxes/deductions: in addition to 2% for sports, the financial explanations describe the fiscal contour of the future regime (confirmed in the materials of Dipres/Ministry of Finance).
- Advertising restrictions and standards of responsible communication (including restrictions on sponsorship of sporting events).

"Until 2023," online in Chile existed in a legal vacuum; since September 2023, the Supreme Court has recorded the illegal status of sites without permission and initiated blocking. In 2024-2025, the country moved to systemic legalization through the Boletín 14838-03 bill, which was approved in general form by the Senate in August 2025 and provides for strict rules for player protection, compliance and sports financing. Until the final adoption and entry into force of the law, online remains outside the "white" regime, and blocking is a key enforcement tool.
