Peru has formed a full-fledged legal framework for distance gambling: after the approval of the MINCETUR regulations, the norms entered into force on February 9, 2024, establishing mandatory licensing for online casinos and betting.
The regulator maintains open registers (platforms/suppliers), and sites are required to comply with the requirements of KYC/AML, responsible play and warning labeling.
The tax regime includes a 12% tax on GGR and a 1% Selective Consumption Tax (ISC) on online gaming/betting (its application since 2025 has sparked debate in the industry).
In practice, the market is moving to a "white" model: operators submit applications, undergo certification, publish licensing details and work under the supervision of MINCETUR.
Since August 13, 2022, online games and distance betting in Peru are regulated by Ley 31557. In October 2023, the D.S. 005-2023-MINCETUR regulations were adopted, and in 2024 practical application and reporting through SUNAT began (including form No. 696).
