Online gambling: legalized from 2022 (Peru)

Peru is one of the few markets in the region where online gambling and distance sports betting operate in a "white" legal framework. The base was laid by Ley N ° 31557 of August 13, 2022, and detailed rules were established by the regulation D.S. N ° 005-2023-MINCETUR of October 13, 2023. Amendments Ley N ° 31806 (June 28, 2023) clarified concepts and procedures. The practical application of the norms began in 2024.

What exactly is legalized

The law regulates "juegos a distancia" (online games/casinos) and "apuestas deportivas a distancia" (distance betting) - you can only work on platforms authorized by MINCETUR. The regulation sets technical standards, control, responsible play and the procedure for authorizing domains/brands and suppliers.

The central organ is MINCETUR (via DGJCMT). The official portal contains the law, regulations and materials for companies: FAQ, forms and explanations.

Key operator requirements (short)

Authorization of the platform/domain/brand in MINCETUR according to the regulations (without authorization - prohibited).

Technology and security: game/RNG certification, event logs, secure data transmission channels to the regulator, fault tolerance.

Taxes and reporting

There is a special tax for online; administration - via SUNAT. Filing declarations - virtual form No. 696 ("Juegos y Apuestas Deportivas a Distancia e ISC") in the Mis declaraciones y pagos service. The ISC also applies to the relevant operations.
