In short: what is possible and what is not in 2025

Online: there is a federal model for fixed sports betting and online casinos (iGaming) from January 1, 2025: mandatory operator authorization, KYC/AML requirements, responsible gaming, platform and content audits.

How is the regulation of the online market

Who regulates. Policy and licensing are centered in the Ministry of Finance through Secretaria de Prêmios e Apostas (SPA); supervision of sites and sports is shared by the Ministry of Sports and the Ministry of Finance (joint orders/orders).

Starting circuit. Regulation is based on Law No. 14. 790/2023 and SPA by-laws (including ordinances that set the windows for submitting applications and checklists of documents in 2024). By January 1, 2025, the regulatory framework came into force for the "white" market.

Bet on GGR. The basic tax on gross gaming income of operators was established by law 14. 790/2023, and in 2025 it was raised to 18% of GGR by a government measure - with application from October 1, 2025. When planning a unit economy, take into account the new rate.

Other liabilities. In addition to GGR, mandatory contributions and fees in favor of supervision; for players there are tax rules for winnings in accordance with federal law (details - based on the results of the operator's reporting).


Advertising, responsibility and player protection

Advertising. Aggressive promises of "easy money," targeting minors, intrusive communication are prohibited; there is a weather control mode and blocking of illegal domains.

Responsible play and age. Basic tools (limits, timeouts, self-exclusion) are mandatory; tighter rules are being discussed (including raising the minimum age to 21 and limits on monthly spending) - keep an eye on new bills.

Payments. Enhanced anti-fraud and AML checks; publicly stated restrictions on loans/cards in rates and an emphasis on verifiable sources of funds - this is reflected in the rules of operators and payment partners.


What about land-based casinos?

Status quo. Playhouses are still banned; in 2025, the Senate raised the topic of their legalization several times (casino resorts, bingo, jogo do bicho), but no decision was made at the time of October 2025.

If legalization passes. A separate tax contour is expected (in the discussion - supervisory fees and a CIDE tax on sales), a strict link to tourism and infrastructure investments. So far, this is a prospect, not a valid norm.
